14a. Aggregate Data Sharing

Anonymous, aggregate insights derived from research survey data may be shared with third parties including researchers, healthcare organizations, employers, policymakers, and mission-aligned organizations working to improve women's health (for example, women's health nonprofits studying symptom trends, university research teams, or healthcare companies developing better perimenopause treatments). We do not share data with advertisers or data brokers. These insights are used to:

15. Dispute Resolution & Arbitration

Any dispute, claim, or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation, or validity thereof, including the determination of the scope or applicability of this agreement to arbitrate, shall be determined by binding arbitration administered in accordance with the rules of the American Arbitration Association (AAA).

The arbitration shall be conducted in the State of California. The arbitrator's decision shall be final and binding. Judgment on the award rendered by the arbitrator may be entered in any court having jurisdiction thereof.

CLASS ACTION WAIVER: You agree that any arbitration or proceeding shall be limited to the dispute between us individually. To the full extent permitted by law, (a) no arbitration shall be joined with any other proceeding; (b) there is no right or authority for any dispute to be arbitrated on a class-action basis; and (c) there is no right or authority for any dispute to be brought in a purported representative capacity on behalf of the general public or any other persons.

16. Governing Law

These Terms of Use shall be governed by and construed in accordance with the laws of the State of California, without regard to its conflict of law provisions. You agree to submit to the personal and exclusive jurisdiction of the courts located in Los Angeles County, California.

17. Severability

If any provision of these Terms is found to be unenforceable or invalid, that provision shall be limited or eliminated to the minimum extent necessary so that these Terms shall otherwise remain in full force and effect and enforceable.

18. Entire Agreement

These Terms, together with our Privacy Policy and Consumer Health Data Privacy Policy, constitute the entire agreement between you and KRUUSH regarding your use of the Site, superseding any prior agreements between you and KRUUSH relating to the Site.
